Wouldn't Chuck be convicted of illegal wiretapping? Doesn't he have a court order to initiate a recording? Howard is right, it would be tough to get the tape admitted in court and wouldn't it hurt Chuck's reputation in the end?

Different states have different laws regarding surreptitious recordings. The legality of it is really secondary though. Chuck is mentally unstable and to the rest of the world, it would just look like his brother said whatever it took to talk him down when he seemed to be in danger of seriously losing it. What's easier to believe, that or what really happened, which sounds like an insane, hopelessly convoluted conspiracy dreamed up by a mentally-ill man and for which there's absolutely no real evidence? I'd like to see some acknowledgment from Howard that he doesn't believe it. He quickly jumped in to go along with Chuck but any reasonably intelligent person in his position would have serious doubts (and if he just goes along with it as the season continues, that's a problem with the writing).

I think Chuck has another idea in mind. Possibly driving Kim away from Jimmy and back to HHM?

I don't think Kim will go back to HHM. I thinknshe already suspects that Jimmy did falsify those legal documents. And she truly feels disappointed with Chuck always being overly critical of his brother. I do think that Kim will end up leaving Jimmy because she's has more integrity and takes her job seriously and Jimmy will jeopardize her reputation like he did to his brother Chuck. I noticed that after the Mesa Verde client talked negatively about Chuck, Kim seemed disturbed by it and began second guessing herself.

yeah you may have a point. i might have forgotten some details about the Kim/HHM relationship
