Legally, It should be Bran, the last of the legitimate sons. As Sansa bluntly put it to Jon, "I'm a girl and you're a bastard". The Watch know who Bran is, but they're just sitting on the information. They could make Bran "Lord Stark" and still let Jon be the King of the North.
(Of course, Bran tends to screw things up and would make a terrible head of the family.)

Good question. I don't know if Bran's status as the Three-Eyed-Raven precludes him from being a Lord or ruler of any land.

Then maybe Bran will live in the cave the three-eyed raven did. He can control the wildlings.
Sansa can marry Snow and rule Winterfell.
Arya is the head stark imo. She's on a mission to rule Westeros.
